Payments
Client will guarantee timely payment of any open balances by supplying credit card in advance, and an additional 4% processing fee applies. A $25 late fee will be incurred for payments not received by the due date. For web design services, any additional fees arising from e-commerce requirements, online databases, domain name, or hosting fees are the responsibility of the client.
Who owns content provided by Creative Stream Marketing?
Creative Stream Marketing operates under commonly accepted practices regarding copyright issues. Creative Stream Marketing retains all ownership rights to all content we create. However, the client retains all usage rights for the term of the agreement. This isn't an unusual idea we thought up. It's how copyright laws work in the United States.
This is easy to understand when you compare it to a music CDÂ you've purchased. Legally, the artist owns the music, but you have the right to use the CD however you wish. In much the same way, Creative Stream Marketing owns the content we create, but you retain the right to use it however you wish. The only usage right we retain is the right to use content for promotional purposes. For example, we will post your newly designed logo on this website.
This is the way things work for content created in the US, whether it's stated or not. The bottom line is that you're free to do nearly anything you like with any content you purchase from Creative Stream Marketing.
Client-Provided Content
As the client, you must own, or have the legal right to use, any images, text, music, or other content you provide Creative Stream Marketing. By supplying this content, or website location of content, you are attesting you own, or have permission to use such content. Creative Stream Marketing assumes no responsibility for any content you provide, and requires you to have written permission from the copyright owner to use it. Any information you provide to us is treated as confidential.
About the Quality of your Finished Product
The overall look of your finished, printed documents greatly depends on the quality of product images you provide. All manufacturers show product images on their websites. These images work fine if you're using them on another website.
However, images used from websites will result in poor quality on your print advertisements. Nearly all manufacturers of product you carry will have "high resolution" product images for print advertising purposes. Don't let your advertising suffer from poor-quality images. Creative Stream Marketing cannot assume responsibility for client-supplied images that do not meet print industry quality standards.
